Terms of service
Effective 18 May 2026.
These terms govern your use of Braain — the shared-brain app for households and small teams. By creating an account or using the app, you agree to them.
Plain-English summary: you own the stuff you put in Braain, we agree to run a working service in good faith, neither of us blames the other for things outside our control, and either of us can walk away at any time.
Who's behind Braain
"Braain", "we", "us" refers to the operator of the Braain app, based in Australia, contactable at support@braain.app.
Your account
- You must be at least 13 years old to use Braain.
- One person per account. Don't share login credentials.
- You're responsible for the activity on your account and for keeping your sign-in method secure.
- If you sign in via Apple, Google, or a magic link, your account is bound to that email address.
Acceptable use
Don't use Braain to:
- Break the law, infringe someone's rights, or harm minors.
- Send spam, harass other users, or impersonate someone you're not.
- Upload malware, sexually explicit content, hate speech, or content that incites violence.
- Reverse-engineer, scrape, or attempt to bypass the security of the service.
- Resell, sublicense, or commercially redistribute Braain itself.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.
Your content
You own the content you create in Braain — your tasks, notes, schedules, messages, attachments, and the spaces you set up. We don't claim ownership of any of it.
To operate the service, you grant us a limited, non-exclusive licence to store, transmit, process, and display your content for the purpose of running Braain for you and the members of your spaces. This licence ends when you delete the content or your account.
You're responsible for making sure you have the right to share whatever you upload (you wrote it, you took the photo, the person agreed to be added, etc.).
The AI agent
Braain includes an AI agent ("@braain") that can answer questions, draft messages, and create things on your behalf. It can also be wrong.
- Outputs are generated by a third-party large language model and should be treated as suggestions, not professional advice (medical, legal, financial, or otherwise).
- Verify anything important before acting on it.
- You're responsible for what you do with the agent's outputs — including any messages you ask it to send on your behalf.
Subscriptions and billing
Plans
Braain is free to use for reading shared content and chatting. Braain+ unlocks creating things, the AI agent, attachments, and unlimited personal spaces. Pricing is shown in-app at the point of purchase.
Free trial
Braain+ includes a 7-day free trial for new subscribers. Cancel before the trial ends and you won't be charged. After the trial, the subscription auto-renews at the published price until you cancel.
Payment
Apple and Google process all subscription payments — we never see your card details. Charges, renewals, and cancellations are handled by the relevant app store and follow its terms (App Store Terms of Service or Google Play Terms of Service).
Cancellation
Cancel any time in your App Store or Play Store account settings. Cancellation takes effect at the end of the current billing period; you'll keep Braain+ until then. We don't issue refunds for unused portions of a billing period — refund requests go through Apple or Google.
Price changes
We may change subscription prices over time. Changes apply only to renewals after we've notified you (via email or in-app), giving you a chance to cancel before they take effect.
Service availability
We aim for Braain to be available all the time but don't guarantee uptime. Planned maintenance, third-party outages, and unexpected bugs happen. We won't be liable for losses caused by Braain being temporarily unavailable.
Braain is currently in active development. Features may change, be removed, or behave unexpectedly. We try to communicate material changes in advance.
Termination
You can stop using Braain and delete your account at any time — see braain.app/delete-account.
We can suspend or terminate your access if you violate these terms, if we're required to by law, or if we discontinue the service. Where the issue isn't a serious breach, we'll try to give you reasonable notice and a chance to export your content.
Disclaimers
Braain is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties of fitness for a particular purpose, merchantability, and non-infringement.
Nothing in these terms is intended to exclude consumer guarantees you have under the Australian Consumer Law or any other non-excludable legal rights.
Limitation of liability
To the maximum extent permitted by law, Braain's total liability to you for any claim arising out of or in connection with the service is limited to the amount you paid us for Braain in the 12 months before the claim arose.
We're not liable for indirect or consequential losses (lost profits, lost data, lost opportunities), even if we knew they were possible.
Indemnity
You agree to indemnify us against claims brought by third parties that arise from your content or your misuse of Braain — for example, someone claiming the content you uploaded infringes their copyright, or that a message you sent through Braain caused them harm.
Governing law
These terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in the courts of New South Wales unless a different forum is required by your local consumer law.
Changes to these terms
We may update these terms as Braain evolves. The "Effective" date at the top reflects the most recent change. For material changes that affect your rights, we'll notify you in-app or by email before they take effect. Continuing to use Braain after that means you accept the new terms.
